Aqua Platforms, Inc. d/b/a AIX (“we,” “our” or “us”) recognizes the importance of protecting your privacy. This Privacy Policy (“Privacy Policy”) describes our practices regarding the information we collect through our platform (the “Platform”). By accessing or otherwise using the Platform, you acknowledge that you have received and read this Privacy Policy.

UPDATES TO THIS PRIVACY POLICY

We reserve the right at any time, to modify this Privacy Policy. All such modifications will be effective upon posting the revised Privacy Policy on the Platform and we will revise the Effective Date at the top of this Privacy Policy. We encourage you to review this Privacy Policy periodically so that you keep up to date on our most current Privacy Policy and practices.

INFORMATION THAT WE COLLECT

We collect information in two ways: (1) directly from you and (2) automatically as a result of your use of the Platform.

Information collected directly from you. We may collect and retain information directly provided by you. For example, we collect information you give us when you:

- Complete applications, subscription agreements or other forms through the Platform;

- Communicate with us, such as to provide feedback, ask for additional information, or make a request;

- Register for or manage an account with us; and

- Subscribe to newsletters, email lists or other content that we provide.

We may collect information such as your first and last name, mailing address, email address, telephone number and any other information that you provide to us. You may choose not to provide certain information to us, but doing so may restrict your ability to use the Platform.

Information Collected Automatically. We may also collect certain information through the use of automated means. When you visit or use the Platform, we may collect information such as:

- Your IP address;

- The type of browser, devices and operating systems you use;

- Identifiers associated with the device(s) you use to access the Platform;

- The pages you visit and the features you use, including dates and times;

- If you navigated from or navigate to another website and the address of that website; and

- Information regarding your internet service provider.

We may collect information about your activities on the Platform through the use of cookies, clear GIFs or web beacons, local shared objects or Flash cookies, heat mapping, tracking pixels or Google Tag Manager, or through other identifiers or technologies, including similar technologies, as they may evolve over time. We refer to these technologies collectively as “Data Technologies.”

We may allow third parties, including Google, to use Data Technologies on the Platform. The information collected by Data Technologies may be shared with and used by us, by others acting on our behalf, or by third parties subject to their own privacy policies. Information collected by Data Technologies may be used on this or on other websites or services, including those that may not be operated by us.

Emails. We may collect information regarding the effectiveness of our email and other communications with you. For example, we may know if you open an email we send or follow a link in an email we send to you.

HOW WE USE INFORMATION

We use the information we collect to:

- Deliver the Platform to you and others;

- Create, administer and maintain your account;

- Respond to your inquiries related to support and other requests;

- Operate our business, including administering, maintaining and improving the Platform;

- Comply with applicable laws and to enforce our policies and End User Access Agreement;

- Prevent fraud, theft, or injury to you, us, or others;

- Contact you, including through telephone, fax, text, email or chat; and

- Perform data analyses or create aggregated data sets combining information about you with that of other visitors to the Platform.

HOW WE SHARE INFORMATION

We may share the information we collect (i) as you expressly authorize us to; (ii) as permitted by law; and (iii) with third parties, including:

Service Providers. We may share information with service providers who help us to administer the Platform, provide technical support, or send communications related to our business. These service providers include analytics companies, such as those that provide Data Technologies on the Platform.

Corporate Affiliates and Partners. We may share certain information with our corporate affiliates for their business purposes, to provide services or for marketing purposes.

Business Transfer. We may share information we have gathered about you in connection with the sale or merger of our business or the transfer of assets.
